English Abstract: Talking about a “creative role of judge”, in the strong sense of “law making” or in the weak, but misleading, sense of discretional interpretation of the law in force, amounts to denying the classical principles of the submission of judge to the law and of separation of powers. Therefore it declares the collapsing of the rule of law. The paper shows the mistakes underlying these view of judicial activity, and namely the the mistakes made by hermeneutics: A narrow understanding of the rule of law; a view of empirical and judicial knowledge that is unsound from the epistemological point of view; an old-fashioned contraposition between abstract legality and concrete justice and the embracing of an alternative reconstruction of judicial reasoning that is completely focused on facts instead of norms.

English Abstract: The emphasis that has been put by Hermeneutics on the role of the interpreter should be mitigated, at the prescriptive level, by the principles that rule the interpretative process in criminal law and that exclude judicial decisions as a source of law. This is true for the reasoning by analogy and the prohibition to go beyond the text in criminal law. From the point of view of the politics of law, according to the author, the tenets of Hermeneutics are not reasons for rebuilding the principles of modern criminal law but reasons for a strong defence of the submission to law, which impede to give precedent a formal legal bindingness.

English Abstract: Judge-made law plays an important role in contemporary criminal law system, which appears to be more and more fragmentary and puzzling with regard to its sources. Adjudication implies a space for creativity. Nevertheless the undeniable judicial creativity is tolerated only on condition that judge’s productive power is limited. Legal hermeneutics shows that the question of interpretation resides in the dialectic tension between creativity and restriction, discretion and rationality. It points out the restraints against arbitrary judgments. According to the principle of legality, the peculiar functions of criminal law deal with the traits of the interpretive process that has the legal text as its object. Legal methodology is functional in need of staying connected to texts. It can provide a basis for rational control of judicial decisions.

English Abstract: The so-called “judicial creationism” has been criticized in criminal law in the name of rule of law. However, the creative role of interpreter cannot be denied even in this branch of law. Furthermore, nowadays judicial discretionality seems to increase in the interpretative steps required by European harmonisation. This happens both as to the disapplication of the domestic norm that is incompatible with the European norm and to the interpretation of the domestic norm in coherence with this latter. In this cases critiques to judicial dicretionality are harder, since interpretation is imposed by international obligations on States and their internal bodies, including judicial institutions.

English Abstract: The paper deals with the nature of actus reus and compares the basic theories of this nature: the type-theories and the abstract-concept-theories. After recapping the main hermeneutical type-theories of the XX Century, the author sets out his own theory of actus reus as type and argues that a type-oriented legal application doesn’t necessarily contrast with the Principle of legality.
